The doctrine of reincarnation is usually associated with Buddhism, Hinduism and other Eastern religions. But it has also been developed in Druzism and Judaism. The doctrine has been used by these traditions to explain the existence of evil within a moral order. Traversing the boundaries between East and West, we explore how Jewish mysticism has employed the doctrine to help answer the problem of evil. We explore the doctrine particularly as we respond to objections against employing it in a theodicy. (...) According to simulation or shared-substrates models of emotion recognition, our ability to recognize the emotions expressed by other individuals relies, at least in part, on processes that internally simulate the same emotional state in ourselves. The term “emotional expressions” is nearly synonymous, in many people's minds, with facial expressions of emotion. However, vocal prosody and whole-body cues also convey emotional information. What is the relationship between these various channels of emotional communication? We first briefly review simulation models of emotion recognition, (...) and then discuss neuroscientific evidence related to these models, including studies using facial expressions, whole-body cues, and vocal prosody. This book addresses two related questions that have first arisen in Toulmin’s seminal book on the uses of argument. The first question is the one of the relationship between the semantic analysis of modality and the structure of arguments. The second question is the one of the distinctive place, or role, of modality in the fundamental structure of arguments. These two questions concern how modality, as a semantic category, relates to the fundamental structure of arguments. The book addresses modality and (...) argumentation also according to another perspective by looking at how different linguistic modal expressions may be taken as argumentative indicators. It explores the role of modal expressions as argumentative indicators by using the Italian modal system as a case study. At the same time, it uses predictions/forecasts in the business-financial daily press to investigate the relation between modality and the context of argumentation. (shrink)

The present essay provides a new metaphysical interpretation of Relational Quantum Mechanics (RQM) in terms of mereological bundle theory. The essential idea is to claim that a physical system in RQM can be defined as a mereological fusion of properties whose values may vary for different observers. Abandoning the Aristotelian tradition centered on the notion of substance, I claim that RQM embraces an ontology of properties that finds its roots in the heritage of David Hume. To this regard, defining what (...) kind of concrete physical objects populate the world according to RQM, I argue that this theoretical framework can be made compatible with (i) a property-oriented ontology, in which the notion of object can be easily defined, and (ii) moderate structural realism, a philosophical position where relations and relata are both fundamental. Finally, I conclude that under this reading relational quantum mechanics should be included among the full-fledged realist interpretations of quantum theory. (shrink)

In our recent article ‘The Ethics of the Algorithmic Prediction of Goal of Care Preferences: From Theory to Practice’1, we aimed to ignite a critical discussion on why and how to design artificial intelligence (AI) systems assisting clinicians and next-of-kin by predicting goal of care preferences for incapacitated patients. Here, we would like to thank the commentators for their valuable responses to our work. We identified three core themes in their commentaries: (1) the risks of AI paternalism, (2) worries about (...) attacks to our humanity stemming from the use of AI and (3) the possibility of designing AI systems for more relevant use cases than the one we consider in our work. We shall focus on these themes, leaving aside some other interesting suggestions, given the limited space available for our response. Diaz Milian and Bhattacharyya discuss the risks of AI paternalism highlighting how the use of an AI to predict goal of care preferences may incentivise clinicians and surrogates to shift the burden of decision making to the machine.2 In particular, ‘[i]f the AI-generated response is given priority above the other agents’2 and the AI makes decisions autonomously, then ‘AI paternalism’ would emerge.2 Against this possibility, the authors suggest four safeguards to be implemented in the AI life-cycle.2 These are procedures that may improve the trustworthiness of the AI and human control over it.3 We agree that it is important …. The essay discusses Donald Davidson’s concept of anomalous monism in the framework of Husserlian phenomenology. It develops in four stages. Section 1 is devoted to a critical presentation of the argument for anomalous monism. Section 2 succinctly examines those Husserlian notions that best provide the ground for a discussion parallel to Davidson’s. In Sect. 3, the aporetic status of “mental causation” is analyzed by providing a genetic-phenomenological account of efficient causation. However, responsible decision-making is characterised by rather difficult epistemic conditions. It applies all the more during the pandemic when decisions require not only specialised knowledge in a number of disciplines, scientific consensus, and participants from different fields, but also responsibility and respect for moral principles in order to ensure that the human rights of all groups are observed. Pandemic measures are created (...) by politicians, healthcare policy-makers, and epidemiologists. However, what is the role of ethics as a moral philosophy and experts in ethics? Experts in ethics and philosophy are carefully scrutinising political decisions. Levy and Savulescu have claimed that Ethicists and philosophers are not epistemically arrogant if they question policy responses. They played an important role in the creation of a reliable consensus. This study analyses epistemic and moral responsibility, their similarities, analogies, and differences. Are they interconnected? Recent research put forward the hypothesis that eye movements are integrated in memory representations and are reactivated when later recalled. However, “looking back to nothing” during recall might be a consequence of spatial memory retrieval. Here, we aimed at distinguishing between the effect of spatial and oculomotor information on perceptual memory. Participants’ task was to judge whether a morph looked rather like the first or second previously presented face. Crucially, faces and morphs were presented in a way that the morph (...) reactivated oculomotor and/or spatial information associated with one of the previously encoded faces. Perceptual face memory was largely influenced by these manipulations. We considered a simple computational model with an excellent match that expresses these biases as a linear combination of recency, saccade, and location. Surprisingly, saccades did not play a role. The results suggest that spatial and temporal rather than oculomotor information biases perceptual face memory. (shrink)

Phenomenology has been defined by Husserl as “theory of the essences of pure phenomena,” yet the ontological status of essences in Husserlian phenomenology is far from a settled issue. The late Husserlian emphasis on genetic constitution and the historicity of the lifeworld is not immediately reconcilablewith the ‘unchangeable’ nature that is prima facie attributed to essences. However, the problem of the nature of ideality cannot be dropped from phenomenological accounts without jeopardizing the phenomenological enterprise as such. Through an immanent analysis (...) of Husserl’s meditation on essences a positive account of their ontological status is provided. Essences are interpreted as ontological thresholds, primordially rooted in our motivated confrontation with sensuous transcendence. Essences appear as emergent ontological features, which are not reducible to their particular realizations and which exhibit a fundamental continuity between consciousness and being. They manifest themselves as prospectively a priori (a precondition for further experiences), but retrospectively a posteriori (they are founded in experience). Finally, essences manifest the ‘co-essential’ nature of consciousness and sensuous transcendence: they are the way in which we are motivated and constitutively bound to articulate being, which in turn is apt to be thus articulated. Clinical ethics committees (CECs) have been developing in many countries since the 1980s, more recently in the transitional countries in Eastern Europe. With their increasing profile they are now faced with a range of questions and challenges regarding their position within the health care organizations in which they are situated: Should CECs be independent bodies with a critical role towards institutional management, or should they be an integral part of the hospital organization? In this paper, we discuss the organizational context (...) in which CECs function in Europe focusing on five aspects. We conclude that in Europe clinical ethics committees need to maintain a critical independence while generating acceptance of the CEC and its potential benefit to both individuals and the organization. CECs, perhaps particularly in transitional countries, must counter the charge of “alibi ethics”. CECs must define their contribution to in-house quality management in their respective health care organization, clarifying how ethical reflection on various levels serves the hospital and patient care in general. This last challenge is made more difficult by lack of consensus about appropriate quality outcomes for CECs internationally. These are daunting challenges, but the fact that CECs continue to develop suggests that we should make the effort to overcome them. We believe there is a need for further research that specifically addresses some of the institutional challenges facing CECs. (shrink)

That the maximization of quality-adjusted life years violates concerns for fairness is well known. One approach to face this issue is to elicit fairness preferences of the public empirically and to incorporate the corresponding equity weights into cost-utility analysis (CUA). It is thereby sought to encounter the objections by means of an axiological modification while leaving the value-maximizing framework of CUA intact. Based on the work of Lübbe (2005, 2009a, 2009b, 2010, forthcoming), this paper questions this strategy and scrutinizes the (...) concomitant assumptions concerning the nature of prioritization decisions. Empirical studies indicate that these premises are in fact unwarranted. People chose a certain resource allocation because they perceive it as a fair way to treat the persons concerned, not because it maximizes something valuable, and it is questionable if prioritization decision can be represented as value-maximizing choices at all. This reflection on the fundamental distinction between deontological and consequentialist reasoning bears general implications for the scope of ‘economic imperialism.’. (shrink)

One challenge while learning scientific concepts is to select relevant information and to integrate different representations of the learning content into one coherent mental model. Virtual reality learning environments offer new possibilities to support learners and foster learning processes. Whether learning in VR is successful, however, depends to a large extent on the design of the VRLE and the learners themselves. Hence, adding supportive elements in VRLEs, such as annotations, might facilitate the learning process by guiding attention and supporting the (...) selection of relevant information. Additionally, the mapping of pictorial and verbal information is eased by these annotations. The beneficial effect of annotations is highly dependent on learners' intrinsic motivation as intrinsic motivation while learning also affects the information selection and visual search patterns. In our experimental study, we compared two conditions: learning in a VRLE with or without annotations. We measured the learning outcome on three different levels. Additionally, we investigated intrinsic motivation as a moderator for the effect of annotations on learning outcome. We found no significant main effect of annotations on learning outcome. The moderating effect of intrinsic motivation for annotations on the overall learning outcome was significant. Our results imply that learners are either intrinsically motivated or need additional support by annotations as these support the selection of relevant information in the VRLE and therefore enable them to learn successfully. Which type or quantity of annotations supports learning processes best needs to be explored in future research. (shrink)

In this paper, I demonstrate how philosophical insights and empirical research on the use of religious language can be fruitfully combined to tackle issues regarding the ontology of religious collectivities and the agency of group actors. To do so, I introduce a philosophical framework that draws on speech act theory and recent advances in the fields of collective intentionality and social ontology, with particular attention paid to the work of Raimo Tuomela. Against this backdrop, I discuss a brief case study (...) based on my fieldwork among Jehovah’s Witnesses in Switzerland and Germany. In particular, I call attention to the structure of the Witnesses’ ritual interactions and to the types of speech acts that are performed in their congregational settings. I argue that the communicative framework provided by these rituals is particularly suited to the creation of genuine group intentions that cannot be reduced to the private intentions of the individual group members. In conclusion, I argue that most of the language used in religious contexts does not deviate much from everyday language; however, particular ritual settings can elicit performative effects and constitute new social realities that can have a concrete impact on both individuals and religious groups. A thriving literature has developed over logical and mathematical pluralism – i.e. the views that several rival logical and mathematical theories can be equally correct. These have unfortunately grown separate; instead, they both could gain a great deal by a closer interaction. Our aim is thus to present some novel forms of abstractionist mathematical pluralism which can be modeled on parallel ways of substantiating logical pluralism (also in connection with logical anti-exceptionalism). To do this, we start by discussing the Good (...) Company Problem for neo-logicists recently raised by Paolo Mancosu (2016), concerning the existence of rival abstractive definitions of cardinal number which are nonetheless equally able to reconstruct Peano Arithmetic. We survey Mancosu’s envisaged possible replies to this predicament, and suggest as a further path the adoption of some form of mathematical pluralism concerning abstraction principles. We then explore three possible ways of substantiating such pluralism—Conceptual Pluralism,Domain Pluralism,Pluralism about Criteria—showing how each of them can be related to analogous proposals in the philosophy of logic. We conclude by considering advantages, concerns, and theoretical ramifications for these varieties of mathematical pluralism. (shrink)

Gestational surrogacy is ethically complex, generating very different responses in law and policy worldwide. This paper argues that contemporary surrogacy law and policy, across many jurisdictions, fail to give sufficient attention to the significance of the relationship between the child and the gestational surrogate. This failure risks repeating the mistakes of historical, discredited approaches to adoption and donor‐assisted conception. This paper argues that proper recognition of the significance of gestation must be an organising principle in surrogacy law and policy. The (...) paper begins by pointing to examples of surrogacy law and practice where the role of the gestator is unacceptably minimised, most notably the framing of the surrogate as a mere ‘carrier’. It goes on to examine the nature of gestation, including consideration of contemporary scholarship on the metaphysics of pregnancy and emerging work in epigenetics, and argues that current evidence supports the view that the gestational relationship must be taken more seriously than it currently is. The paper then draws analogies with parenthood in donor‐assisted conception and adoption to argue that approaches to parental status in novel family formations that fail to promote transparency and seek to deny the truth of familial relationships are doomed to fail. The paper concludes by suggesting some implications for law and policy that flow from placing sufficient emphasis on the gestational role. The overarching thesis of this paper is that gestational surrogacy is ethically permissible when these fundamental requirements are adhered to, and that surrogacy law should proceed on this basis. Current debates on human rationality are divided between what Matthew Boyle calls the additive and transformative approaches. My concern is not with the current debate, but with Boyle’s alignment of Descartes and Aristotle with the modern approaches, directing his criticisms against the former, and his defence in support of the latter. What motivates my enquiry is whether Boyle’s use of the two philosophers’ theses stands up to scrutiny and consequently whether his alignments are cogent. We begin our commentary by summarizing the commonalities and differences in cognitive phenomena across cultures, as found by the seven papers of this topic. We then assess the commonalities and differences in how our various authors have approached the study of cognitive diversity, and speculate on the need for, and potential of, cross-disciplinary collaboration.

Appeals to the miraculous are common in healthcare, and arguments about end-of-life decision-making can quickly become theological. Assessments of hope have been recommended within the biopsychosocialspiritual model of medicine, but these assessments fail to account for the theological dimension of hope. Examples of failed assessments include recent efforts in palliative care and classic works, such as On Death and Dying by Elisabeth Kübler-Ross. To adequately address the patient’s and family members’ hopes without patronizing or harming the patient, assessments must be (...) done by a person trained in theology. (shrink)

Artists have been one of the occupational categories that has suffered the most from the economic crisis due to COVID-19. Artists’ “portfolio careers”, generally based on freelancing and self-employment not protected by regulations and welfare, are one of the main reasons of this financial emergency. Their odd forms of employment are rooted – among other things – in a peculiar understanding of artistic work, which I call artistic work exceptionalism (AWE). AWE sees artistic work as essentially different from regular jobs. (...) It finds its conceptual source in Western philosophical aesthetics, which presents the making of art in contrast with regular jobs. In this paper, I take issue with AWE and show its limits and negative implications. By placing emphasis on the heretofore neglected relationship between art and work, I argue that, in principle, creating art is (or should be regarded as) in continuity with other forms of employment, and therefore there is much to be learned from other professions at the level of artistic labor reforms. I call this view artistic work normalism (AWN). In defending AWN, my goal is not to desecrate artists’ occupation. Quite the contrary, my theoretical framework stems from a desire to recognize the social value of the arts. I propose two different approaches to the economics of art promoting artists’ well-being and the exercise of creativity: strengthened public art funding and the financialization of art. (shrink)

Concretism is the ontological thesis according to which possibilia are concrete entities. The paper first outlines concretism, arguing that its sole founding thesis is that individuals across possible worlds are individuated by similitude. Among other things, this means that there is no need to postulate that there is no overlap among worlds. This article examines how and why criminal proceedings were brought against alleged cases of Catholic mysticism in several European countries during modernity. In particular, it explores how criminal charges were derived from mystical experiences and shows how these charges were examined inside the courtroom. To bring a lawsuit against supposed mystics, justice systems had to reduce their mysticism to ‘facts’ or actions involving a breach of the law, usually fraud. Such accusations were not the main reason why alleged mystics were (...) taken to court, however. Focusing on three representative examples, in Spain, France and Germany, I argue that ‘mystic trials’ had more to do with specific conflicts between the defendant and the ecclesiastical or secular authorities than with public concern regarding pretence of the supernatural. Criminal courts in Europe approached such cases in a similar way. Just as in ecclesiastical inquiries, during the trials, judges called upon expert testimony to debunk the allegedly supernatural. Once a mystic entered the courtroom, his or her reputation was profoundly affected. Criminal lawsuits had a certain ‘demystifying power’ and were effective in stifling the fervour surrounding the alleged mystics. All in all, mystic trials offer a rich example of the ways in which modern criminal justice dealt with increasing enthusiasm for the supernatural during the 19th century. (shrink)

Das ist eine Lesart der Position Wittgensteins, deren exemplarischer Vertreter etwa Stanley Cavell ist. Meine These dagegen lautet, dass die Lebensformtheorie einem erkenntnistheoretischen Dogma aufruht, dessen Überwindung Wittgensteins eigentliches Anliegen war: Es ist das Dogma, dass die grundlegende Bedeutung des Wissensbegriffs in der Beschreibung eines einzelnen Aktes besteht, und (...) nicht in der Beschreibung von etwas, das auf einer logisch anderen Ebene steht: nämlich einer Fähigkeit. Damit soll nicht bestritten werden, dass die Idee einer bestimmten Lebensform wesentlich ist für die Beschreibung erkenntnisfähiger Subjekte. In this paper I begin to fashion a theory of musical form that I call historical formalism. Historical formalism posits that our perception of the formal properties of a musical work is informed by considerations not only of artistic categories but also of the historical, sociopolitical, and cultural circumstances within which that work was composed.

: This paper combines Simondon’s philosophy of individuation with some aspects of post-humanist and‘new materialist’ thought, while, at the same time, remaining within the ambit of a more classically ‘historical’characterisation of materialism. Two keywords drawn from Karen Barad and Simondon respectively – ‘ontoepistemology’and ‘axiontology’ – represent the red thread of a narrative that connects the early modern invention of civil science to Wiener’s cybernetic theory ofsociety. The political stakes common to these forms of what I call ‘banal’ materialism, Simondon attacked (...) ontologically,epistemologically and politically. The conceptual tools Simondon’s philosophy of individuation elaborates prove tosupport a ‘non-banal’ materialist critique of the alleged ‘unsocial sociability’ of human nature theorised in modernpolitical theory. A genuine materialist approach, as I will argue, allows us to shift political thinking from politicsconceived as a problem to be solved to politics as an arena of strategic experimentation. (shrink)
